If a commercial theme is released under the GNU/GPL then you can redistribute it free, under the same license. You don’t need to mod it first. However, the license also requires that the original copyright notices remain intact. In this theme you have removed WooThemes copyright notices and added your own. This is not in the spirit of the GPL and it exposes you to legal risks for copyright infringement.
What you need to do is to leave the WooThemes credits in the source files (including style.css) and simply add your own notices eg. “Modifications (c)Premium Mod”. This means that WooThemes license is respected and you get credit for whatever mods you make.
@elpie: I’ve made the modification (by leaving the WooThemes credits to the download. I’ve also drop an email to you for further clarification. Thanks again.
Might I also be so bold as to suggest that the “Made by” link that is displayed in the footer should include “Made by {link to original} and Premium Mod”?
@andrew: We’d love to give the credit in the footer but by including the original author in the ‘Made by’ part would certainly confuse the users. It might gave the wrong impression that the original author has part in the mod too.
@admin (if that is your real name): Good point, I’m sure the original authors would not want to be credited with changes they did not make; however, I have faith that an appropriate combination of words could be produced that would not cause undue confusion.
@andrew: We’ve updated the footer credit. Take a look!
Uh, its just a file inside the zip.. did something wrong?
anto: Can you try again? Does it work now?
Would I ever suggest using a theme with 4 footer links?
One is bad enough
Next we are going to see people insisting that internal RSS widgets for theme owners are left intact.
You don’t see Michel Valdrighi with a footer link on every WordPress installation and the WP default blogroll sill skews the web though not to delveloper blogs any more.
@andy: you are totally free to remove every single footer links
nice theme….
